Crane operator rules in New York

What New York says about who may operate a crane: the State Labor Department certificate of competence outside New York City under General Business Law section 482, and the New York City Hoisting Machine Operator licence with its limited classes for articulating boom cranes, mini cranes, boom trucks and telehandlers.

Outside New York City: the State certificate of competence

General Business Law section 482(1) says no individual shall operate a crane without holding a valid certificate of competence issued by the commissioner of labor. Section 482(3) says no employer, contractor or agent may knowingly permit an individual to operate a crane without one. Section 483 lets the commissioner make rules covering examinations, categories of certificates, age and experience requirements, fees, and limits and exemptions. The Department of Labor's applicant instructions say an individual or owner who operates a crane on a construction, demolition or excavation site outside New York City must obtain the certificate.

The same instructions set these requirements: an applicant must be at least 21 years old, have at least three years of practical experience operating a mobile crane or tower crane, and have practical knowledge of crane maintenance. They exclude an uncontrolled physical defect or illness that might decrease competence, with epilepsy, heart disease and uncorrected vision or hearing defects as examples. There is a general examination, then a practical examination in crane operation. Experience is shown by letters on company letterhead, or by proof of equipment ownership and a reference letter for the self-employed. The form lists a fee of US$150, non-refundable, sent as a check or money order with a paper application. The form also says the whole process can be completed online. It names 12 NYCRR Part 61, the OSHA crane standard and ASME B30.5 among its reference sources. New York City: the licence and its classes

The city's business portal says a Hoisting Machine Operator licence is needed to use a crane or other hoisting machine in New York City, and that the DOB issues it. It lists three classes: Class A for machines with a boom length under 200 feet, Class B for machines with any boom length, and Class C for machines under 50 tons. A DOB notice dated June 2018 on national crane certification says a Class A applicant, new or renewing, shows a valid NCCCO or Crane Institute Certification card with at least four named mobile or lattice crane types, with a tower crane card added to operate a tower crane. The same notice says Class B needs all four NCCCO crane types plus the tower crane type. These details come from a notice of that date, and the portal does not repeat them.

Limited classes since November 7, 2024

The DOB page on limited licences says that as of November 7, 2024 a DOB-issued licence is required to operate an articulating boom crane, mini crane or rotating telehandler in New York City. Three new limited classes were created for them. The older Class C2 licence was retitled the limited licence for boom trucks and Class C3 the limited licence for sign hanging cranes, with no change in scope or qualifications. The page lists these qualifications for every limited class: at least 18 years old, able to read and write English, fit to perform the work, of good moral character, holding relevant NCCCO certifications, and a Department-approved 40-hour Hoisting Machine Operator Course completed in the year before applying. Applicants for the articulating boom crane, mini crane or telehandler licence who applied on or before November 6, 2024 needed only an approved 8-hour course completed in the two years before.

Experience required

For applications on or after November 7, 2024 for an articulating boom crane, mini crane or telehandler licence, the page requires two years of experience operating hoisting machines under the direct supervision of a licensed operator within the three years before applying. One of those years must be in New York City on the machine type for the licence. The two years must include outrigger placement across at least 100 crane set-ups, 25 of them on the listed machine type. Experience on an articulating boom crane, mini crane or rotating telehandler in the city on or before November 6, 2024 may be credited at a rate of 125 hours to 1 month. The page says 1,500 hours of qualifying experience meets the one-year city requirement and 3,000 hours meets the full two years. Experience is recorded on a DOB affidavit signed by the applicant and the employer or union. Boom truck and sign hanging crane licences use the same two-year structure.

What a dated DOB notice says about articulating boom cranes

A DOB reminder dated August 2015 said prior DOB approval was not required to use an articulating boom crane at a jobsite when it was used only to load or unload a truck or trailer, the boom did not exceed 135 feet and the material was not raised vertically more than 100 feet. For any other use, it listed a prototype approval, a certificate of operation, a certificate of on-site inspection and an operator holding an articulating boom endorsement. The notice carried a post-until date of June 30, 2016 and refers to Section 3319.3 of the New York City Building Code. The notice itself says nothing about the 2024 limited licence classes.

Tree work

None of the pages read mentions tree work or arboriculture. The city pages describe work in connection with building or infrastructure construction, alteration or demolition, temporary structures, and delivery or retrieval of materials to or from a building, and exclude work in industrial or commercial plants or yards.
