Storm contractor rules in Idaho: Contractor Registration Act, the emergency price clause and consumer protection penalties

Idaho registers construction contractors through the Idaho Contractors Board under title 54, chapter 52, with a US$2,000 project floor, and its Consumer Protection Act has an emergency price clause that names fuel, food, pharmaceuticals and water. This page restates those sections and the board fee table as the Legislature and the Division of Occupational and Professional Licenses publish them, read on October 9, 2026.

Checked against the sources at the bottom of this page on October 9, 2026. Rules, fees and pay change: the source has the last word.

This page reports what the official source says. It is not legal advice: ask the office named here. The wider picture is on the storm contractor rules page. Every row is statute text or the board's own fee table. None of the sections names tree work, and no official page on an Idaho door-to-door sales cancellation right was read for this page on October 9, 2026.

The sections in one table

SectionWhat it says
54-5203, construction and contractorConstruction means building, altering, repairing, adding to, subtracting from, improving, reconstructing, moving, excavating, wrecking or demolishing any building, highway, road, bridge or other structure, project, development or improvement to real property. A contractor is anyone who undertakes, offers to undertake, bids on or performs construction
54-5204, registration requiredIt is unlawful to engage in the business of, or hold oneself out as, a contractor in Idaho without being registered. A contractor may not engage another contractor who is required to be registered unless that contractor shows proof of registration
54-5205, exemptionsAmong the listed exemptions: one project whose total contract price for labor and materials is under US$2,000 (not when it is part of a larger project or split to evade the chapter), an operation related to clearing or other work on rural land for fire prevention, a farmer or rancher in a horticulture or other farm operation, a contractor in the logging industry building forest access roads, an owner working on the owner's own residential property, and employees of a contractor
54-5210, applicationThe application is under oath and lists tax identification, business name and address, owners, proof of workers' compensation insurance or a statement why it is not required, and a certificate of general liability insurance of not less than US$300,000 single limit. The board sets the registration fee, not to exceed US$150 per year
54-5211 and 54-5214A registration runs from not less than 24 months to not more than 5 years as the board decides in section 54-5211, and a certificate is valid from one to five years under section 54-5214. The registration number is displayed on advertising, contracts, permits, letterheads and purchase orders within 60 days of issue
54-5209, permitsBuilding inspectors ask for an Idaho contractor registration number before issuing a permit. A permit to an exempt person carries the phrase "no contractor registration provided"
54-5215, disciplineAfter an opportunity for a hearing, the board may reprimand, suspend or revoke a registration or impose a civil penalty of not more than US$1,000. Grounds include violating the chapter, violating the Consumer Protection Act with fraudulent misrepresentations to consumers, and dishonest or dishonorable dealings
54-5217, penaltyActing as a contractor without the registration the chapter requires is a misdemeanor, punishable by a fine of not more than US$1,000, up to six months in the county jail, or both. An unregistered contractor, unless exempt, may not bring a court action to collect compensation without proving registration or exemption at all times during the work
48-603(19), emergency pricingTaking advantage of a disaster or emergency declared by the Governor or the President by selling or offering fuel, food, pharmaceuticals or water for human consumption at an exorbitant or excessive increased price to the ultimate consumer is an unlawful practice. It applies only to the location and for the duration of the declaration. A court weighs the price before and after, added costs and the length of the declaration. There is no private cause of action under this subsection
48-606, Attorney GeneralThe Attorney General may seek a declaratory judgment, an injunction, damages or restitution for consumers, and civil penalties of up to US$5,000 per violation, plus expenses, investigative costs and attorney's fees
48-608, private actionA person who suffers an ascertainable loss from an unlawful practice may treat the agreement as voidable or sue for actual damages or US$1,000, whichever is greater. An elderly or disabled person may recover an enhanced penalty of US$15,000 or treble the actual damages, whichever is greater, when the court finds the defendant knew or should have known and one of five listed losses followed
48-615, injunctionViolating an injunction or consent order carries a civil penalty of not more than US$10,000 per violation
Board fee table, effective July 1, 2026Individual and business registrations each show US$120 for an application or initial registration, US$60 for an annual renewal, US$120 for a biennial renewal, and a US$40 reinstatement fee on top of renewal. The page says the board began moving to biennial registration on October 14, 2025

What registration involves

Idaho runs a registration with insurance proof and a board: the application asks for workers' compensation proof and a US$300,000 general liability certificate, and the section 54-5205 exemptions cover small projects, farm operations and owners on their own homes. The definition of construction reaches work "to real property" and does not name trees, so whether a tree company is a contractor under it is a question for the Idaho Contractors Board. The board lists a phone number of (208) 334-3233 on its page and a public search for registrations.

The emergency price clause and storm work

The Idaho clause covers four things by name: fuel, food, pharmaceuticals and water for human consumption. Tree removal and repair services are not in the text read. The same section also lists unconscionable methods, acts or practices in trade or commerce as unlawful, and the Attorney General enforces the chapter with civil penalties of up to US$5,000 per violation. For how other states treat tree work, see contractor licences for tree work. The scam warnings that attorneys general issue after storms are on the storm tree scams page.
