Storm contractor rules in Montana: construction contractor licence, personal solicitation sales and consumer protection fines
Montana's code for 2025 holds a construction contractor licence in title 37, chapter 45, after the old registration chapter in title 39 was renumbered and repealed, and it gives buyers three business days to cancel a personal solicitation sale. This page restates those sections and the Consumer Protection Act fines as the Legislature publishes them, read on October 9, 2026.

Where the contractor rules sit
The 2025 code table of contents shows title 39, chapter 9, headed Contractor Registration, as renumbered and repealed, with section 39-9-211 renumbered 37-45-104 and section 39-9-205 renumbered 37-45-205. The history line under 37-45-102 reads "En. Sec. 2, Ch. 644, L. 2025". The definition lists structures and improvements attached to real estate and does not name trees, so whether a tree company is a construction contractor under it is a question for the Montana Department of Labor and Industry. The fee amount is set by the department and the statute gives no figure.
Personal solicitation sales and storm work
Part 5 applies to telephone and in-person contacts and carves out sales the buyer started. How a storm-damaged tree fits is a question for the state office that enforces the Consumer Protection Act.
